LightningSite Terms & Conditions

Introduction & Trading Information

LightningSite is a trading name of Nordic Creative Limited, registered in England & Wales (Company Number: 07580121), registered office at Kemp House, 152 City Road, London, EC1V 2NX. For the remainder of these Terms and Conditions, “LightningSite” refers interchangeably to Nordic Creative Limited.


LightningSite Hosting Terms & Conditions

Client Responsibility

Clients are solely responsible for their website content’s accuracy, legality, and compliance.

Fair Use Policy

  • No excessive bandwidth or CPU usage impacting server performance.
  • No illegal or infringing content storage.
  • No spam or abusive behavior.

Violations may lead to suspension or termination.

100-Day Money-Back Guarantee

Refund excludes onboarding/development work (£65/hr + VAT).

Service Level Agreement (SLA)

  • 99.9% uptime guarantee.
  • 2-hour support response (Mon-Fri, 9am-6pm UK).

Backup Policy

  • Twice-weekly full site backups (Wed & Sun).
  • Daily database backups (last 7 retained).
  • Encrypted backups via Backblaze, stored across three servers.

Cancellation Policy

  • Annual: Unused months refunded minus development fees.
  • Monthly: No refunds, ends at period conclusion.

Scheduled Maintenance

Outside UK working hours.

Data Migration

Free migration via third-party tools. Not liable for issues from previous hosts.

Domain & Email Hosting

Domain management available; no email hosting provided.

Multi-Site Policy

Clients must be sole contact; no direct customer/subcontractor support.

Prohibited Content

No hosting of violent, extremist, illegal, immoral, provocative, firearms-related content.

Professional Indemnity Insurance

Coverage up to £1,000,000 (Hiscox Insurance Ltd, EU/UK excluding USA/Canada).

Limitation of Liability

No liability for indirect damages or loss from technical issues beyond direct control (third-party outages, acts of God).

Account Reinstatement

No fees for reinstating suspended accounts after issue resolution; timelines may vary.

Applicability

Engaging our development services constitutes acceptance of these terms.

Quotations, Invoicing & Payments

  • Quotations valid 30 days; adjustments may apply for specification changes.
  • 30% deposit required upfront; payment delays extend project deadlines.
  • Delays beyond 10 working days without agreement result in invoicing for completed work.
  • Final 70% invoiced at project completion (‘go-live’); due within 7 days.
  • Changes during the build phase require revised quotations.
  • We reserve rights to suspend/remove online materials for payment non-compliance.
  • Smaller ad hoc changes up to £1,000 require no deposit.

Warranty Period

All web development projects carry a 12-month warranty from the completion (‘go-live’). Defects from our work rectified free; excludes client changes or third-party software/plugins issues.

Professional Indemnity Insurance

Coverage up to £1,000,000 (Hiscox Insurance Ltd) within EU & UK, excluding USA or Canada claims.

Termination

Clients may terminate projects anytime; work completed billed hourly. Additional charges may apply for significant deviations from brief.

Support & Ongoing Work

Billed hourly (minimum increment 0.5 hrs). Rates subject to change with 30-day notice. Monthly invoicing in arrears.

Revisions & Feedback

Feedback opportunities provided during design/development phases. Significant changes may incur charges.

Project Deadlines

Deadlines depend on client responsiveness and timely material provision.

Compatibility

Websites tested on common browsers/OS. Special compatibility requirements must be communicated upfront.

Intellectual Property & Liability

Ownership transfers to client upon full payment. Design credits must remain 12 months post-launch unless otherwise agreed. LightningSite not liable for losses due to inaccuracies, delays, or client content/media loss.


LightningSite Affiliate Programme Terms & Conditions

Commissions & Payments

  • £200 one-off payment per qualifying referral after 100-day guarantee.
  • 20% ongoing commission on monthly/annual subscriptions and add-ons.
  • Commissions paid monthly post 100-day satisfaction guarantee.
  • Minimum payout: £50 (PayPal/BACS/Stripe), otherwise £250 if manual payment required.

Affiliate Restrictions & Misuse

No spam, unsolicited emails, self-referrals, misrepresentation, or bidding on LightningSite branded keywords. Misuse or fraudulent activities lead to termination of commission eligibility.

Affiliate Dispute Resolution

Contact affiliates@lightningsite.io for tracking issues or commission disputes. We value our partners and aim for swift resolutions.

Changes & Governing Law

LightningSite reserves the right to alter/terminate the programme without notice. Existing commissions honoured. Governed by UK law.
